Terms of Service

1. Agreement

Brandnetic is operated by Efficiency Strength Training, LLC (“we”, “us”). By creating an account or using Brandnetic you agree to these terms and to our Privacy Policy. If you use Brandnetic for a company, you agree on its behalf and confirm you may do so. You must be at least 18.

2. The service

Brandnetic helps you plan, make and test advertising creative: a Brand Kit, creative direction, images and video made with third-party AI models, controlled experiments, and read-only performance from ad platforms you connect. Features change as we improve the service.

3. Accounts and workspaces

Keep your sign-in details secure and your account information accurate. Work happens in workspaces. A workspace owner decides who joins and with what role, manages billing, and is responsible for what members do there.

4. Plans, generations and payment

• Generations. Paid image and video requests use generations. An image, or up to 5 seconds of video, is one generation; longer video uses one per 5 seconds, 1080p or 4K uses twice as many, and editing an existing video uses four times as many. Brandnetic shows what a request uses before you confirm it. Drafts made inside Brandnetic do not use generations.
• Plans. Plans are billed in advance, monthly or yearly, and renew automatically until cancelled. Each paid period adds the plan's generations (a yearly plan adds the year's at once). Unused plan generations carry over for one billing period; older ones expire. Plan changes take effect at the next renewal.
• Packs. Packs are one-time purchases of generations that never expire.
• Payment. Payments are processed by Stripe. Prices are shown before you buy and may include tax where it applies. We may change prices; a new price applies to a plan from its next renewal after we tell you. If a payment fails, no new generations are added until it succeeds.
• Cancelling. Cancel any time in Manage billing. Your plan stays active to the end of the period you paid for and does not renew. Generations you already have stay available.

5. Refunds

Plan payments are not refunded; when you cancel, you keep the plan until the end of the paid period. A pack with none of its generations used can be refunded if you ask within 14 days of buying it. Generations that have been used are not refundable. None of this limits any refund the law requires. To ask for a refund, or if you think you were charged in error, email [email protected] before disputing the charge with your bank.

6. Your content and what Brandnetic makes

Your brand materials, uploads, briefs and the creative made for you are yours, to the extent the law allows. You give us permission to store and process them, and to send them to the model providers that do the work, only to provide Brandnetic to you. You confirm you have the rights to what you upload, including any people, products, music and marks in it.

AI output can be inaccurate, can resemble other material, and may not be protectable by copyright everywhere. Review creative before you publish it. You are responsible for your ads and the claims in them. Brand Guardian and Product Truth help you check wording against your own rules; they are not legal review.

7. Acceptable use

Do not use Brandnetic to make or publish anything illegal, infringing, deceptive or harmful: false or unsupported claims, impersonation, sexual content involving minors, harassment, or content that breaks the policies of the ad platforms or model providers involved. Do not try to get around generation limits, interfere with the service, access other workspaces, or reverse engineer Brandnetic.

8. Other services

Brandnetic relies on other companies, including Stripe for payments, AI model providers for generation, and the ad platforms you connect. Their terms also apply to your use of them, and we are not responsible for their availability or decisions.

9. Suspension and ending

You can stop using Brandnetic at any time, and an owner can deactivate a workspace. We may suspend or end access for a breach of these terms, non-payment, or to protect the service or others, and we will tell you why where we can. You can ask us to delete your data as described in the Privacy Policy.

10. Disclaimers

Brandnetic is provided “as is” and “as available”. We do not promise that it will be uninterrupted or error-free, or that any creative will improve your advertising results.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages or lost profits, revenue or data, and our total liability for any claim about Brandnetic is limited to the amount you paid us in the 12 months before the claim.

12. Indemnity

You will cover our reasonable costs from claims by others arising from your content, your ads, or your breach of these terms.

13. Changes

We may update these terms. If a change is material we will tell you in Brandnetic or by email before it takes effect. Using Brandnetic after that means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in South Carolina.
